• level 1 claims (straightforward claims such as unlawful deductions) - £160 issue fee; £230 hearing fee
• level 2 claims (more complex claims) - £250 issue fee; £950 hearing fee
• Employment Appeal Tribunal - £400 appeal fee; £1,200 hearing fee
• there are several other fees such as £60 for an application to dismiss following settlement and £600 for judicial mediation
Given that the response paper says that the fees will not cover the actual cost of operating the Employment Tribunal system, the fee structure will be subject to review once its implemented so it seems likely that the fees will increase.
No doubt there will be mixed feelings about the changes, which are intended to be implemented in Summer 2013, with some believing that fees will reduce the number of weak claims being made and others believing that they will hinder access to justice to those who need it. Time will tell...
