Law Society Fixed-Fee Guidance

New guidance from the Law Society of Scotland just published last week encourages firms offering legal services to the public to publish indicative price information up front. Here at MBM Commercial we are ahead of the game, and at the beginning of January this year MBM’s Dispute Resolution Team launched a new fixed-fee litigation service – offering clients a level of clarity, value and control currently unseen in the marketplace.

A report published by the Competition and Markets Authority on the legal services market in England and Wales in 2016 indicated significant concern that some people are put off seeking professional legal advice altogether as they are worried they cannot afford it. In particular, our new fixed-fee litigation service, provides clients with a bespoke fee.

Due to the nature of litigation, and the vast range of cases and client requirements, each fixed-fee arrangement offered by MBM to our clients is specifically tailored to the particular work that is required to bring about the best possible outcome for the client. We will provide you with a fully itemised budget for the entire case; broken down into each particular element with a clear explanation of the associated fee. Clients can also pay each stage of the litigation as a fixed-fee instalment. This allows clients to budget appropriately and spread the cost over several months.

Clients still have the option of paying fees calculated on the more traditional hourly basis, as we recognise that this may be more appropriate for some depending on the business of the client. However, we believe that offering both options upfront provides the client with a genuine choice, and certainty for those who want and need it.

The guidance issued by the Law Society does not apply to solicitors who provide legal services to businesses, but we believe that all clients can benefit from upfront and transparent information regarding the cost of legal services.
